SUBDIVISIONS AND LAND DEVELOPMENT

    1. CU-2026-0002 – Sheetz, Inc., 405 Memory Lane

HEILMAN Mr. Heilman reiterated the aspects of the plan as was presented at the Conditional Use Hearing.

SWOMLEY Chairman Swomley referenced the four requested modifications and two waivers:

      • 325-200.D.(2) Service and loading areas must be visually screened from the street and pedestrian ways.

A modification has been requested to allow two loading areas for the project – one is for a delivery truck; the second loading area is for the refilling of the underground fuel tanks.

      • § 325-200.D.(3) Service and loading areas shall be located on the side or rear of the building.

A modification has been requested to allow the service and loading areas to be in the front yard at this site. The applicant states that the location of this loading area is limited by the location of the underground tank.

      • § 325-200.D.(3) Pole Signs are Prohibited.

A modification has been requested for relief from this ordinance. Discussion was held as to whether a monument sign would be an option.

      • § 325-200.G.(5) Parking facilities shall be permitted only to the rear or side of the principal structure. Due to two front yards, a modification has been requested to allow parking in the front yard.
      • § 325-200.K. Storage, parking and/or display of vehicles in the front yard setback shall be prohibited.

A waiver has been requested to allow parking in the front yard setback. The applicant proposes parking along the portion of the property that runs parallel to Memory Lane. Ten of these parking spaces are located partially within the front yard setback.

      • § 325-204 Public Plaza

A waiver has been requested not to require the placement of a public plaza as the site proposes to provide outdoor seating.

BISHOP   Mr. Bishop commented on the process of the conditional use, noting if there were any modification or waiver which was denied, could it be re-presented during the land development submission.

HEINZ Att. Heinz indicated the requests are requirements in the zoning ordinance related to the conditional use approval in the Town Center Overlay. If the waivers/modifications are not approved at this time, they will need to design it in

accordance with whatever waiver/modification was not granted, pending if the applicant would move forward. If not granted now, they would have to go through the process again later on due to the zoning ordinance. He noted the land development plan would be based on whatever relief is granted at this time and if not enough, they may not proceed with the land development plan.

COMMUNICATION FROM SUPERVISORS

DVORYAK Mr. Dvoryak provided an update on YAUFR noting at the most recent meeting it was unanimously decided to move forward with the engagement of RKL to do a calculation of what the correct apportionment figure should be for the three participating municipalities. It was also agreed to split the cost of the engagement – a third to each municipality. It will be determined how to fund it, since YAUFR’s budget did not have the item included for this year, and it may require an additional contribution from each municipality equal to their share of the fee.
