NEW BUSINESS

    1. Request to Transfer Restaurant Liquor License Number R-14193 to CHR Corp. (Rutter’s) 1099 Haines Road, York Pennsylvania

Attorney Jack Byrnes, Associate General Counsel for Rutters Solicitor Sanders provided the rules of the proceedings for the request.

Att. Byrnes stated he submitted a written application to the Township Secretary, with a request resolution for the intermunicipal transfer of the restaurant liquor license from Somerset County to the existing Rutters #1 location.

Att. Byrnes reviewed the internal and external procedures which are followed concerning the sale of alcohol. He indicated Rutters currently has 94 locations across four states.

Seventy-six locations are licensed to sell alcohol. With the restaurant liquor license there are two requirements, one is accommodating 30 seats in the store which he noted this location does. With the requirement for permitting on-premises consumption of alcohol, which is a legal requirement, Rutters has an in-house rule where on premises consumption is limited to 25 ounces of malt beverage. No wine or other beverages are permitted. He noted they are in adherence to the Pennsylvania Liquor Control Board Responsible Alcohol Management program (RAMP). All 72 of the licensed locations are RAMP certified which will be acquired for Store #1. There are four main pillars:

  • Owner/manager training
  • Seller/server training for all employees over 18 years or older, 50% of the employees need to be trained for certification. At Rutters they strive for 100% training at all locations.
  • New employee orientation – all employees within 30 days of hire are provided a state sanctioned sheet which reviews the basics of retail operations
  • Signage providing warnings of intoxication, etc.

Mr. Byrnes stated Rutters has a 100% carding policy at all locations requiring valid ID to purchase alcohol at their store. ID scanning technology is at all locations. Employees are trained on the PLCB system. Also trained to handle suspicious or strange activity.

Regarding safety, all locations have security monitoring both interior and exterior of the store.

In closing Mr. Byrnes stated Rutters has proven to be a responsible alcohol retailer at all its locations. Under Pennsylvania law a municipality may deny a request for a transfer if substantial objective evidence was presented that the transfer would be a detriment to the health, welfare, peace and morals of the community. As no substantial evidence was presented to that effect, he respectfully requested the Board approve Rutters request.
